Marijuana laws are changing across the country, and having a surprisingly profound impact on employers – not just in Colorado.

In addition to the existing 24 states and District of Columbia that have legalized marijuana for medical use and the four states that allow recreational use, 13 states are currently considering legalization measures – eight of which will vote on this matter in November.

Businesses must now determine how to operate in an era when marijuana, still federally illegal as a Controlled Substances Act Schedule 1 drug, is increasingly being legalized at the local and state levels.

Many employers and job seekers aren’t sure where state laws end and federal laws begin. This has created confusion for employers and many lack a coherent policy that covers a multi-state workforce.

Are Electronic Logging Devices on Track for 2017 Implementation?

In December 2015, the Federal Motor Carrier Safety Administration issued its final rule requiring the use of electronic logging devices (ELDs) for most drivers and carriers currently required to keep paper logs.

Shortly after the rule was finalized, the Owner-Operator Independent Driver’s Association (OOIDA) filed a legal challenge against it.

While the group was successful in having a previous ELD rulemaking vacated, ATA believes that OOIDA’s arguments against the 2015 final rule won’t stand up to legal scrutiny. Let’s take a look at their primary arguments.

New Proposal Sets a Higher Bar for Bigger Fleets – Is that Fair?

Earlier this year, the Federal Motor Carrier Safety Administration (FMCSA) proposed a new method for assigning motor carriers’ safety fitness determinations (SFD), commonly called safety ratings.

Currently, safety ratings are assigned after the completion of a labor-intensive compliance review (CR) – or audit – of records at the carrier’s place of business.

FMCSA now proposes to also use data from its Compliance Safety, Accountability (CSA) Safety Measurement System (SMS), in addition to information gathered during on-site compliance reviews, to make SFDs on a monthly basis.
