A failed drug test doesn't have to be the end of the road for your truck drivers. According to the FMCSA Clearinghouse Report, more than 90,000 drivers have had at least one reported violation and only around 19,000 have completed the return-to-duty process. These numbers are crippling to an industry that is already experiencing a severe driver shortage.
Termination is not a legal requirement. A company that has had a driver who violated a DOT regulation can opt to retain the driver and have them go through the return-to-duty and follow-up testing process.
