Over a year has passed since the first outbreak of COVID-19, and while certain facets of employment legislation have gathered traction in the global media – particularly polarizing discussions around mandatory vaccinations and remote working policies – familiar themes impacting HR professionals and employment screening continue to evolve, albeit more slowly than usual.

This perspective covers employment law updates so far in 2021 that were not introduced due to the pandemic, and that may have otherwise been overlooked. “Ban-the-box” legislation, credit history restrictions, pay equity and equal reporting laws, and growing numbers of statewide medicinal and recreational marijuana accommodations are among the areas of employment law that have recently seen developments amid, and in spite of, the COVID-19 pandemic.
